Welcome to Memory Lane! These Terms of Service ("Terms") govern your access to and use of Memory Lane's website, mobile application, and related services (collectively, the "Service").

By accessing or using Memory Lane, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Eligibility

You must be at least 18 years old to use Memory Lane. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Account Registration

To use Memory Lane, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

Acceptable Use

You agree to use Memory Lane only for lawful purposes. You may not:

• Violate any applicable laws, regulations, or third-party rights
• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate any person or entity, or falsely represent your affiliation
• Interfere with or disrupt the Service or servers/networks connected to it
• Attempt to gain unauthorized access to any part of the Service
• Use automated means (bots, scrapers) to access the Service without permission
• Transmit viruses, malware, or other malicious code
• Reverse engineer, decompile, or disassemble any part of the Service

User Content

Memory Lane allows you to upload and store content such as photos, videos, notes, and other materials ("User Content"). You retain ownership of your User Content.

License to Us: By uploading User Content, you grant Memory Lane a limited, non-exclusive, royalty-free license to store, display, and process your User Content solely to provide the Service to you. We will not use your User Content for any other purpose without your consent.

Your Responsibilities: You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate any third-party rights (copyright, trademark, privacy, etc.)
• Your User Content complies with these Terms and applicable laws

We reserve the right to remove User Content that violates these Terms or is reported as inappropriate, without prior notice.

Multi-Parent Households

Memory Lane supports multi-parent households with up to 4 parents per household. When you invite another parent:

• All household members can view and edit shared profiles and milestones
• You are responsible for ensuring invited members comply with these Terms
• Any household member can remove themselves or others from the household
• Disputes between household members are your responsibility to resolve

Google Photos Integration

If you connect your Google Photos account:

• You grant Memory Lane permission to access photos you explicitly select through the Google Photos Picker
• Selected photos will be downloaded, resized, and stored in your Memory Lane account
• You are responsible for ensuring you have the rights to import and store the selected photos
• Google's Terms of Service apply to your use of Google Photos
• You can disconnect Google Photos at any time, but previously imported photos will remain in your account unless you delete them

Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or unforeseen technical issues. We are not liable for any disruptions or loss of access to the Service.

Intellectual Property

Memory Lane and its original content, features, and functionality are owned by Memory Lane and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be error-free, secure, or uninterrupted
• Warranties regarding the accuracy, reliability, or completeness of content

Developmental Information: Memory Lane provides milestone tracking tools and information for educational purposes only. We are not medical professionals. Always consult qualified healthcare providers for concerns about your child's development.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMORY LANE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the Service
• Loss or corruption of User Content
• Unauthorized access to your account
• Errors, bugs, viruses, or other harmful components in the Service

Our total liability to you for all claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months prior to the claim, or $50 USD if you have not made any payments.

Indemnification

You agree to indemnify, defend, and hold harmless Memory Lane, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your violation of these Terms, your User Content, or your use of the Service.

Termination

By You: You may terminate your account at any time by contacting support or using the account deletion feature.

By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide notice when reasonably possible.

Upon termination, your right to use the Service will cease immediately. Your User Content will be deleted according to our data retention policies outlined in the Privacy Policy.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice in the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Memory Lane operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.
